A Michigan based Carpentry company asked our TRADITION LIEN SERVICE division to record an Michigan Claim of Lien for non-payment for labor and materials provided on a fencing project in Warren, Mi within Macomb county. According to WIKIPEDIA Warren was named for War of 1812 veteran, and frontier cleric, Rev. Abel Warren.
A MICHIGAN Claim Of Lien must be recorded by General/Prime Contractors and Subcontractors at the office of the Register Of Deeds in the County where the improved property was located within ninety (90) days from the last day of providing equipment, labor, materials or services for the project. Subcontractors should also record a copy of the previously delivered Notice Of Furnishing along with the Claim Of Lien. A recorder’s stamped copy of the Claim Of Lien should also be served within fifteen (15) days of filing the Claim Of Lien to all legal parties for the project (Owner, General Contractor, Customer, Lender/Surety).
The Macomb County Recorder’s fees to record are as follows: A flat recording fee of $30 (document size 8-1/2″ x 11″). Make checks payable to MACOMB COUNTY REGISTER OF DEEDS. Be sure to send a self-addressed stamped envelope.
A lawsuit to foreclose on the property must be filed within one (1) year from the date of recording the Claim Of Lien. If the lawsuit is not filed, the Register Of Deeds can then invalidate the expired Claim Of Lien.
