Notice Of Project Commencement
SOUTH CAROLINA Code Annotated § 29-5-23 mandates that a Notice Of Project Commencement be filed with the clerk of court or register of deeds in the county where the improvement is located by the General Contractor. This notice provides interested parties in the construction project with legal party information needed to follow the construction lien procedures properly. Copies of the Notice Of Project Commencement and Location Notice should be posted at a conspicuous place at the job site, and sent by mail to any Subcontractors on the project who request in writing a copy of it.

Notice Of Furnishing Labor Or Materials
SOUTH CAROLINA Code Annotated § 29-5-40 mandates that when a General/Prime Contractor has filed a Notice Of Project Commencement, in order for a Subcontractor to ensure the full amount owed can be collected on a lien for a private project, a Subcontractor must deliver by Certified Mail or personal delivery a Notice Of Furnishing Labor Or Materials to the legal parties (Customer, Owner, General/Prime Contractor, Lender) on the project.

Conditional Waiver and Release Upon Final Payment
Issue a Conditional Waiver And Release Upon Final Payment to the Owner and any other legal parties requesting a copy after a promise is made for full and final payment for labor or materials provided for a project. You can always issue a Unconditional Waiver And Release Upon Final Payment after the check clears.

Notice Of Mechanic’s Lien (General/Prime Contractor)
SOUTH CAROLINA Code Annotated §29-5-90 mandates that a Notice Of Mechanic’s Lien (General/Prime Contractor) should be filed by a General/Prime Contractor no later than ninety (90) days after the completion of furnishing equipment, labor, materials or services for an improvement. It should be recorded with the register of deeds or the clerk in the county where the improved property is located. The recorded lien should then be promptly mailed by certified mail or personally delivered to the improved property’s Owner, Agent or Trustee along with other legal parties for the project (Lender/Surety, Customer).

Satisfaction Of Mechanic’s Lien
SOUTH CAROLINA Code Annotated §29-5-430 mandates that a Satisfaction Of Mechanic’s Lien should be recorded by a General/Prime Contractor or Subcontractor promptly after a satisfactory payment or agreement is received for a previously recorded Notice Of Mechanic’s Lien. It should be recorded with the register of deeds or the clerk in the county where the improved property is located. The recorded Satisfaction Of Mechanic’s Lien should then be promptly mailed by certified mail or personally delivered to the improved property’s Owner, Agent or Trustee along with other legal parties for the project (General/Prime Contractor, Lender/Surety, Customer).
