On private Commercial projects GEORGIA Code Annotated § 44-14-361.5(c) mandates that Subcontractors have to deliver (certified mail highly recommended) a GEORGIA Notice To Contractor to the Owner and the Prime/General Contractor within thirty (30) days of the filing of a GEORGIA Notice Of Commencement or the first day of delivery of materials or beginning labor at a property. It is advisable that along with the Owner and the Prime/General Contractor any other legal parties related to the improvement of the property (Customer, Lender and other legal parties) get sent the GEORGIA Notice To Contractor. GEORGIA Code Annotated § 44-14-361.3 allows Subcontractors the option of filing of a GEORGIA Preliminary Notice Of Lien Rights in the Office of the Clerk of the Superior Court of the county where the construction improvement is located. This notice is for alerting the Owner of a potential future lien claim. It is not required in order to record a future GEORGIA Claim Of Lien. The deadline to record a GEORGIA Preliminary Notice Of Lien Rights is within the last thirty (30) days of providing equipment, labor, materials or services for a project. As required by law, a check for the filing fee of $5.00 is required. If the notice is not recorded in person, a self-addressed, stamped envelope to return a recorded copy of this notice.
