Specially Fabricated Materials Notice

TEXAS Property Code § 53.056 mandates that Subcontractors who specially fabricate materials that are unsuitable for use on other projects are entitled to file a Lien Affidavit – Subcontractor if a Specialty Fabricated Materials Notice is sent by Certified Mail to the Owner and other legal parties on a project (Customer, General Contractor, Lender). This helps protect a Subcontractor from the risk of cancellation of an order before delivery.

TEXAS Property Code § 53.047 mandates that a Retainage Agreement Notice must be sent by certified mail to the Owner no later than the fifteenth (15th) day of the second month following the initial delivery of equipment, labor, materials or services by a Subcontractor.

Second Month Notice

TEXAS Property Code § 53.056 mandates that Subcontractors who don’t have a have a contract with the General/Prime Contractor, they must notify the General/Prime Contractor that they have a contract with a another Subcontractor (Sub of a Sub) with a balance due for supplied equipment, labor, materials or services. This notice must be sent by the 15th day of the second month when there is a balance due. This notice is not to be sent to the Owner.

On residential projects, a General/Prime contractor may file a Claim On Lien (Subcontractor/Supplier) by the 15th day of the month, three (3) months after after the completion of providing equipment, labor, materials or services for a project. The claim must be recorded with the County Clerk in the county where the project is located. Mail a recorded copy to all legal parties on a project (Owner, Lender/ Surety).
