Preliminary Notice Of Intention To File A Claim

PENNSYLVANIA Consolidated Statutes § 1501(a) mandates that a Preliminary Notice Of Intention To File A Claim should be served by the Subcontractor who is in contract with someone other than the Owner (General/Prime Contractor, another Subcontractor) on or before the completion of furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It should be delivered in person, or by Certified Mail, to the Owner of the property. It is advisable that along with the owner any other legal parties related to the improvement of the property (Owner, Customer, Lender and General Contractor) get sent the Preliminary Notice. While it is no longer required by Pennsylvania Consolidated Statutes effective January 1, 2007, it will greatly improve the timeliness of payments when there are multiple subcontractors on a project.

Issue a Conditional Waiver And Release Upon Progress Payment to the Owner and any other legal parties requesting a copy after a promise is made for partial payment for labor or materials provided for a project through a certain date. Formal Notice Of Intention – Subcontractor

PENNSYLVANIA Consolidated Statutes § 1501(b) mandates that when there is a balance due after completion of providing labor, services, equipment or materials for the improvement of a project, the Formal Notice Of Intention – Subcontractor is a warning prerequisite that must be provided by first class, registered or certified mail to the Owner thirty (30) days before a Claim Of Lien is filed. For maximum effectiveness, it is recommended that it also be sent to the project’s other legal parties (Customer, General/Prime Contractor, Lender).

Claim On Lien – Contractor

PENNSYLVANIA Consolidated Statutes § 1503 mandates that a Claim Of Lien – Contractor must be filed with the Prothonotary of the Court of Common Pleas of the county in which the project is located. It must be recorded no later than six (6) months after completion of providing labor, services, equipment or materials for the improvement of a project. A recorded copy of the Claim needs to be delivered to the Owner and other legal parties (Owner Agent, Lender) with a Notice Of Filing Of Claim within one (1) month after the Claim Of Lien is recorded.
