Request For A Copy Of A Notice Of Commencement

A Request For A Copy Of A Notice Of Commencement is sent by a Subcontractor providing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It is sent to the General/Prime Contractor along with the Owner of a project, who have then ten (10) days to produce to the requesting Subcontractor a Notice Of Commencement.

Notice Of Commencement – Private Project

OHIO Revised Code Annotated § 1311.04 mandates that a Notice of Commencement announces that work is starting for the the improvement on a home building or remodeling project. This notice provides interested parties in the construction project with legal party information needed to follow the construction lien procedures properly. A copy of the Notice of Commencement should be posted at a conspicuous place at the job site, and sent by mail to any Subcontractors on the project who request in writing a copy of it.

Notice Of Furnishing – Private Project

OHIO Revised Code Annotated § 1311.05 mandates that a Notice Of Furnishing – Private Project must be served by Subcontractors to the Owner on a Commercial or New Residential project within twenty-one (21) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to the jobsite.

NOTE: If the property Owner does not respond within ten (10) days of receiving a Request For A Notice Of Commencement, the Notice Of Furnishing twenty-one (21) day deadline can be delayed until the Notice Of Commencement is received. The date the Notice Of Commencement is received restarts the twenty-one (21) day deadline.

It must be delivered in person, or by Certified Mail, to the Owner of the property. It is advisable that along with the Owner any other legal parties related to the improvement of the property (Customer, General/Prime Contractor, Lender/Surety) get sent the OHIO Notice of Furnishing.

OHIO Revised Code Annotated § 1311.261 mandates that a Notice Of Furnishing – Public Project must be served to the General/Prime Contractor on a public project (city, county, state, authority) within twenty-one (21) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It must be delivered in person, or by Certified Mail, to the General/Prime Contractor for the project. It is advisable that any other legal parties related to the improvement of the property (Public Agency/Authority, Customer and Lender/Surety) get sent the Notice of Furnishing.

Issue a Conditional Waiver And Release Upon Final Payment to the Owner and any other legal parties requesting a copy after a promise is made for full and final payment for labor or materials provided for a project. Affidavit For Mechanic’s Lien

OHIO Revised Code Annotated 1311.06 mandates that a Affidavit For Mechanic’s Lien must be filed by a Prime/General Contractor, Subcontractor, laborer or materialman with the county recorder for the county where the improvement is located after the last date that equipment, labor, materials or services were furnished. Timelines for recording are as follows:

Residential: Sixty (60) days
Commercial: Seventy-five (75) days
Oil/gas wells: One hundred twenty (120) days

Copies of the recorded lien must be sent by certified mail or personal delivery within thirty (30) days to the Owner/Owner Agent. It is also recommended that a copy get delivered to the other legal parties for the project (General/Prime Contractor, Lender/Surety. Customer).
