A Notice To Owner Of Materials Supplied Or Work Or Services Performed is an optional document that can be served to all legal parties on a project (Customer, Owner, General Contractor, Lender) after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It improves your chances of being paid on a timely basis, as it notifies all legal parties of your future right to file a lien in the event you are not paid on a timely basis.

Conditional Waiver And Release Upon Final Payment
Issue a Conditional Waiver And Release Upon Final Payment to the Owner and any other legal parties requesting a copy after a promise is made for full and final payment for labor or materials provided for a project. You can always issue a Unconditional Waiver And Release Upon Final Payment after the check clears.

Conditional Waiver And Release Upon Progress Payment
A Conditional Waiver and Release Upon Progress Payment is used where the lien claimant is required to execute a waiver and release in exchange for or to induce the payment of a progress billing and the lien claimant is not in fact paid in exchange for the waiver and release or a single payee check or joint payee check is given in exchange for the waiver and release.

Unconditional Waiver And Release Upon Final Payment
An Unconditional Waiver and Release Upon Final Payment is sent to the Owner and any other legal parties requesting a copy after receiving full and final payment for labor or materials provided for a project. You forfeit your lien rights in the event you are not paid – issue only after payment clears the bank.

Notice Of Unpaid Balance And Right To Lien
NEW JERSEY Statutes Annotated § 2A:44A-20 mandate that before a Construction Lien Claim may be filed a Notice Of Unpaid Balance And Right To File Lien must be delivered (Certified Mail highly recommended) to the Owner within five (5) months after the completion of providing labor or materials at a property. Additional legal parties, including the Lender/Surety, should be delivered the Notice Of Unpaid Balance And Right To File Lien.

Construction Lien Claim
NEW JERSEY Statutes Annotated § 2A:44A-8 mandate that a notarized Construction Lien Claim can be recorded within ninety (90) days of last providing labor, services, equipment or materials at a project. It is recorded with the county clerk in the county where a project you provided labor, services, equipment or materials. You then have ten (10) days to furnish to the Owner a recorded copy of the Construction Lien Claim .

Certificate Of Discharge Of Notice Of Unpaid Balance And Right To File Lien
A Certificate Of Discharge Of Notice Of Unpaid Balance And Right To File Lien should be recorded by a Subcontractor promptly after a satisfactory payment or agreement is received for a previously recorded Notice Of Unpaid Balance And Right To File Lien. It is recorded with the county clerk in the county where a project you provided labor, services, equipment or materials. The recorded Certificate Of Discharge Of Notice Of Unpaid Balance And Right To File Lien should then be promptly mailed by certified mail or personally delivered to the improved property’s Owner, Agent or Trustee along with other legal parties for the project (General/Prime Contractor, Lender/Surety, Customer).
