Notice To Contractor By Subcontractor’s Materialman
A Notice To Contractor By Subcontractor’s Materialman may be given to a General Contractor by a Materialman who is a 2nd tier contractor, or Subcontractor of a Subcontractor. It informs the Contractor that a material supplier to a Subcontractor who may be previously unknown to the Contractor could be filing a claim if prompt payment is not received.

Notice Of The Right To Claim A Lien
MONTANA Code Annotated § 71-3-532 mandates that a Notice Of The Right To Claim A Lien must be served to all legal parties on a project (Customer, Owner, General Contractor, Lender) within twenty (20) days after first furnishing construction related labor, services, equipment or materials. It must be sent by Certified Mail or personal delivery. The notice must also be filed with the Clerk and Recorder of the county where the project is located no later than five (5) business days after the notice is mailed or delivered personally to the project’s Owner.

Construction Lien
MONTANA Code Annotated § 71-3-536 mandates that you must file a Mechanic’s Lien Statement with the County Recorders Office in the County where the project occurred. It must be filed within ninety (90) days after a Notice Of Completion is filed or the completion of providing labor, rental equipment, or materials for the project. After recording, a copy should be delivered in person or by Certified Mail to the Owner of the property along with any other legal parties related to the improvement of the property (Customer, Lender, General Contractor).

Construction Lien Release
A notarized Construction Lien Release is used if you are paid in full for a previously recorded Construction Lien. File it at the Recorder’s Office in the County where your work of improvement occurred. Send copies after it is recorded to all the legal parties for the project.
