Subcontractors Notice Of Claim

MISSOURI Revised Statutes §429-100 mandates that ten days prior to recording a valid mechanic’s lien, all Subcontractors must serve on the Owner a Subcontractors Notice Of Claim, with additional copies mailed by certified mail to to all legal parties on a project (Customer, Owner, General Contractor, Lender). It must be served within the six month time period allowed for recording a Mechanic’s Lien Statement.

Lien Statement – General/Prime Contractor

MISSOURI Revised Statutes § 429-080 mandate that a General/Prime Contractor on a commercial or residential project must record a Lien Statement after the last day of supplying equipment, labor, materials or services to a project according to the following deadlines:
Equipment: Sixty (60) days
Labor, Materials, or Services: Six (6) months

A notarized Lien Statement should be recorded with the Clerk of the District Court in the county where a project you provided construction related equipment, labor, materials or services is located. The recorded notice should then be promptly delivered in person or by Certified Mail to the Owner of the property and the General/Prime Contractor along with any other legal parties related to the improvement of the property (Customer, Lender/Surety).
