General/Prime Contractor’s Pre-Lien Notice
MINNESOTA Statutes § 514.011 Subdivision 1 mandates that a General/Prime contractor on a private Commercial or residential project must deliver a General/Prime Contractor’s Pre-Lien Notice to both the Owner and/or the Owner’s Authorized Agent within ten (10) days after the work of improvement is agreed upon. The Notice should be delivered in person or by Certified Mail to the Owner of the property and/or the Owner’s Authorized Agent along with any other legal parties related to the improvement of the property (Customer, Lender). This notice can be included within a written contract. If there is no written contract, the General/Prime Contractor’s Pre-Lien Notice must printed and delivered to the Owner of the property and/or the Owner’s Authorized Agent.

Subcontractor’s Pre-Lien Notice
MINNESOTA Statutes § 514.011 Subdivision 2 mandates that a Subcontractor on a commercial or residential project must deliver a Subcontractor’s Pre-Lien Notice to both the Owner and General/Prime Contractor within forty-five (45) days of first supplying materials, labor or equipment to a project. The Notice should be delivered in person or by Certified Mail to the Owner of the property and the General/Prime Contractor along with any other legal parties related to the improvement of the property (Customer, Lender).

Conditional Waiver And Release Upon Final Payment
Issue a Conditional Waiver And Release Upon Final Payment to the Owner and any other legal parties requesting a copy after a promise is made for full and final payment for labor or materials provided for a project. You can always issue a Unconditional Waiver And Release Upon Final Payment after the check clears.

Issue a Conditional Waiver And Release Upon Progress Payment to the Owner and any other legal parties requesting a copy after a promise is made for partial payment for labor or materials provided for a project through a certain date. You can always issue a Unconditional Waiver And Release Upon Progress Payment after the check clears.

An Unconditional Waiver and Release Upon Final Payment is sent to the Owner and any other legal parties requesting a copy after receiving full and final payment for labor or materials provided for a project. You forfeit your lien rights in the event you are not paid – issue only after payment clears the bank.

Mechanic’s Lien Statement
MINNESOTA Statutes § 514.08 mandates that you must file a Mechanic’s Lien Statement with the County Recorders Office in the County where the project occurred. It must be filed within one hundred twenty (120) days after the completion of providing labor, rental equipment, or materials. It should also be delivered in person or by Certified Mail to the Owner of the property along with any other legal parties related to the improvement of the property (Customer, Lender, General Contractor).
