Notice Of Furnishing
MICHIGAN Construction Lien Act § 570.1109 mandates that a Notice Of Furnishing is a prerequisite to claiming a lien. It must be served to all legal parties noted on a project’s Notice Of Commencement (Customer, Owner, General Contractor, Lender) within twenty (20) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite.

Full Conditional Waiver

Notice Of Intent To File A Claim Of Lien, Stop Notice Or Bond Claim
A Notice Of Intent To File A Bond Claim, Claim Of Lien Or Stop Notice should be send to all legal parties for the project (Owner, General Contractor, Customer, Lender/Surety) as a documented 10-20 day warning that further legal action will be forthcoming if arrangements for payment are not received.

Claim Of Lien
MICHIGAN Construction Lien Act § 570.1111 mandates that a notarized Claim Of Lien must be recorded within ninety (90) days from the last day of providing equipment, labor, materials or services for the project. Subcontractors should also record a copy of the previously delivered Notice Of Furnishing along with the Claim Of Lien. A recorder’s stamped copy of the Claim Of Lien should also be served within fifteen (15) days of filing the Claim Of Lien to all legal parties for the project (Owner, General Contractor, Customer, Lender/Surety).
A lawsuit to foreclose on the property must be filed within one (1) year from the date of recording the Claim Of Lien. If the lawsuit is not filed, the, Register Of Deeds can then invalidate the expired Claim Of Lien.

Proof Of Service Of Claim Of Lien
A recorder’s stamped copy of the Claim Of Lien along with a Proof Of Service Of Claim Of LIen should also be served within fifteen (15) days of filing the Claim of Lien to all legal parties for the project (Owner, General Contractor, Customer, Lender/Surety).

MICHIGAN Construction Lien Act § 570.1110 mandates that a Sworn Statement is a full accounting to the Owner by a party filing a Claim Of Lien of all the Contractors and Subcontractors due money for a project that have not been paid.

Discharge Of Construction Lien
A notarized Discharge Of Construction Lien is used if you are paid in full for a previously recorded Claim Of Lien. File it at the Recorder’s Office in the County where your work of improvement occurred. Send copies after it is recorded to all the legal parties for the project.
