Statement Of Claim (General/Prime Contractor)
LOUISIANA Revised Statutes Annotated § 9:4822(G) mandate that a Statement Of Claim must be recorded within thirty (30) days after the filing of a Notice Of Termination. If a Notice Of Termination has not been filed, a Statement Of Claim must be recorded within sixty (60) days of completion of providing labor or materials or the completion of the entire project. It is recorded at the Recorder Of Mortgages’ office in the parish where a project you provided construction related labor, services, equipment or materials is located. A recorded copy of a Statement Of Claim must be sent to the Owner of the improved property, with copies being sent also to the other legal parties (Lender/Surety, Customer).

LOUISIANA Revised Statutes Annotated § 38:2242(B) mandate that a Statement Of Claim-Public Project must be recorded within forty-five (45) days after the Public Authority records an acceptance of work of Notice Of Default. It is filed with the Public Authority for which the improvement was done for and recorded at the Recorder Of Mortgages’ office in the parish where a project you provided construction related labor, services, equipment or materials is located. A recorded copy of a Statement Of Claim-Public Project must be sent to the Public Authority of the improved property, with copies being sent also to the other legal parties (Lender/Surety, Customer).

A Release Of Statement Of Claim should be recorded by a General/Prime Contractor or Subcontractor promptly after a satisfactory payment or agreement is received for a previously recorded Statement Of Claim. It is recorded at the Recorder Of Mortgages’ office in the parish where a project you provided construction related labor, services, equipment or materials is located. A recorded copy of a Release Of Statement Of Claim must be sent to the Owner of the improved property, with copies being sent also to the other legal parties (General Contractor, Lender/Surety, Customer).
