Twenty Day Preliminary Notice
ARIZONA Revised Statutes § 33-992-01 mandates that a Twenty Day Preliminary Notice (Private Work) must be served to all legal parties on a project (Customer, Owner, General Contractor, Lender) within twenty (20) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. Each day after the 20th day, you lose 1/20 of your financial interest in the financial value of construction related labor, services, equipment or materials your company provided for the project. A Preliminary Notice may be given out at a later point in time, but your financial recovery for a Mechanic’s Lien, if filed, can only be for the 20 day period prior to the Preliminary Notice being filed.

Conditional Waiver And Release On Final Payment
ARIZONA Revised Statutes § 33-1008(D)(3) mandates that you issue a Conditional Waiver And Release On Final Payment to the Owner and any other legal parties requesting a copy after a promise is made for full and final payment for labor or materials provided for a project. You can always issue a Full Unconditional Waiver And Release On Final Payment after the check clears.

Conditional Waiver And Release On Progress Payment
ARIZONA Revised Statutes § 33-1008(D)(1) mandates that you issue a Conditional Waiver And Release On Progress Payment to the Owner and any other legal parties requesting a copy after a promise is made for partiall payment for labor or materials provided for a project through a certain through date. You can always issue a Full Unconditional Waiver And Release On Progress Payment after the check clears.

Unconditional Waiver And Release On Final Payment
ARIZONA Revised Statutes § 33-1008(D)(4) mandates that you issue a Unconditional Waiver And Release On Final Payment to the Owner and any other legal parties requesting a copy after receiving full and final payment for labor or materials provided for a project. You forfeit your lien rights in the event you are not paid – issue only after payment clears the bank.

Unconditional Waiver And Release On Progress Payment
ARIZONA Revised Statutes § 33-1008(D)(2) mandates that a Unconditional Waiver And Release of Progress becomes effective based on a check being received for a progress payment for labor or materials provided for a defined period of time. It waives Claim of Lien, Stop Notice or Bond Rights rights and states that you have been paid for giving up those rights.

Notice And Claim Of Mechanic’s And Materialman’s Lien
ARIZONA Revised Statutes § 33-993(A) mandates that you must file a Notice Of Claim Of Mechanic’s And Materialman’s Lien with a copy of the previously delivered AZ Twenty day Preliminary Notice at the County Recorders Office in the County where the project occured. The Notice must be filed wihin sixty (60) days after a Notice of Completion is filed, or one hundred twenty (120) days after the completion of the entire project. It should also be served by First Class Mail to all legal parties on a project (Customer, Owner, General Contractor, Lender).

Stop Notice
ARIZONA Revised Statutes §§ 22-1051 et seq mandates that for bonded projects (Private) a Stop Notice must be served upon the Contractor and the bonding company to stop the payment of funds to a General Contractor by the bonding company. It takes the place of a Notice And Claim Of Mechanic’s And Materialman’s Lien, and should be sent to all legal parties for a Project (Customer, Owner, General, Lender/Surety).
