Optional. A Preliminary Notice delivered to the Owner and other legal parties soon after the start of a private Commercial project is effective in reminding all parties of future Bond, Mechanic’s Lien or Stop Notice rights for slow/non payment.

On private Commercial projects VIRGINIA Code Annotated § 43-5 mandates that a notarized VIRGINIA Memorandum For Mechanic’s Lien Claim By General Contractor must be recorded by General Contractors no later than ninety (90) consecutive calendar days of last providing labor, services, equipment or materials at a project.

VIRGINIA Code Annotated § 43-8 mandates that a notarized VIRGINIA Memorandum For Mechanic’s Lien Claim By Subcontractor must be recorded no later than ninety (90) consecutive calendar days of last providing labor, services, equipment or materials at a project.

VIRGINIA Code Annotated § 43-10 mandates that a notarized Memorandum For Mechanic’s Lien Claim By Sub-Subcontractor must be recorded by Sub-Subcontractors no later than ninety (90) consecutive calendar days of last providing labor, services, equipment or materials at a project.

All notarized liens are recorded at the Clerks office of the Circuit Court in the city or county where a project you provided labor, services, equipment or materials is located. The recorded copy should then be sent immediately by certified or registered mail, return receipt requested to the legal parties for project (General/Prime Contractor, Lender/Surety, Subcontractor, Owner).

Claimants are required to file suit to foreclose on a VIRGINIA Mechanic’s Lien within six (6) months after a lien is recorded or sixty (60) days from the date the entire improvement was completed.
