OHIO Revised Code Annotated § 1311.05 mandates that a OHIO Notice Of Furnishing – Private Project must be served by Subcontractors to the Owner on a Commercial project within twenty-one (21) days AFTER first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to the job site. NOTE: Do not send prior to first day day on job.

NOTE: If the property Owner does not respond within ten (10) days of receiving a Request For A Notice Of Commencement, the Notice Of Furnishing twenty-one (21) day deadline can be delayed until the Notice Of Commencement is received. The date the Notice Of Commencement is received restarts the twenty-one (21) day deadline.

It must be delivered in person, or by Certified Mail, to the Owner of the property. It is advisable that along with the Owner any other legal parties related to the improvement of the property (Customer, General/Prime Contractor, Lender/Surety) get sent the OHIO Notice of Furnishing.

Copies of the recorded lien must be sent by certified mail or personal delivery within thirty (30) days to the Owner/Owner Agent. It is also recommended that a copy get delivered to the other legal parties for the project (Customer, General/Prime Contractor, Lender/Surety).

A foreclosure action must be filed by Claimants within six (6) years of the date the OHIO Affidavit For Mechanic’s Lien was recorded.
