NEW MEXICO Statutes Annotated § 48-2-6 mandates that on a private Commercial project, General/Prime contractors can record a notarized NEW MEXICO Claim Of Lien up to one hundred twenty (120) consecutive calendar days after substantial completion of the entire project.

Subcontractors can record a NEW MEXICO Claim Of Lien at any time up to ninety (90) consecutive calendar days after substantial completion of the entire project.

Record the lien with the Couny Clerk in the county where the project is located. The recorded lien should then be promptly mailed by certified mail or personally delivered to the improved property’s Owner, Agent or Trustee along with other legal parties for the project (General/Prime Contractor, Lender/Surety, Customer).

Claimants who recorded a lien must commence a foreclosure suit against the liened property within two (2) years of the date a NEW MEXICO Claim of Lien was recorded.
