MINNESOTA Statutes § 514.011 Subdivision 2 mandates that a Subcontractor have up to forty-five (45) days on a private Commercial project under 5,000 square feet in size to deliver by certified mail a MINNESOTA Subcontractor’s Pre-Lien Notice to the Owner and other legal parties after first furnishing equipment, materials, labor or services. It is suggested that if the project size is greater than 5,000 square feet a Pre-Lien Notice still be done, but it is optional.

MINNESOTA Statutes § 514.011 Subdivision 1 mandates that a General/Prime contractor on a private Commercial project must deliver a General/Prime Contractor’s Pre-Lien Notice to both the Owner and/or the Owner’s Authorized Agent within ten (10) days after the work of improvement is agreed upon. The Notice should be delivered in person or by Certified Mail to the Owner of the property and/or the Owner’s Authorized Agent along with any other legal parties related to the improvement of the property (Customer, Lender).

This notice can be included within a written contract. If there is no written contract, the General/Prime Contractor’s Pre-Lien Notice must printed and delivered to the Owner of the property and/or the Owner’s Authorized Agent.
