INDIANA Code § 32-8-3-1 mandates that on Existing Residential projects (owner-occupied) an INDIANA Preliminary Notice must be served by the Subcontractor who is in contract with someone other than the Owner (General/Prime Contractor, another Subcontractor) to the Owner of an improvement within thirty (30) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It must be delivered in person, or by certified mail, to the Owner of the property. It is advisable that along with the owner any other legal parties related to the improvement of the property (Customer, General/Prime contractor, Lender/Surety) get sent the INDIANA Preliminary Notice.

The notice must also get recorded by a Subcontractor within the same time period at the County Recorder’s office in the county where the project originates.
