Optional. After first day providing equipment, labor, or materials and prior to recording a IN Intention To Hold Lien, Subcontractors can deliver a Preliminary Notice to remind Owner GC and other legal parties of future right to file a Mechanic’s Lien.

INDIANA Code § 32-8-3-1 mandates that on Existing Residential projects (owner-occupied) an INDIANA Preliminary Notice must be served by the Subcontractor who is in contract with someone other than the Owner (General/Prime Contractor, another Subcontractor) to the Owner of an improvement within thirty (30) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It must be delivered in person, or by certified mail, to the Owner of the property. It is advisable that along with the owner any other legal parties related to the improvement of the property (Customer, General/Prime contractor, Lender/Surety) get sent the INDIANA Preliminary Notice.

The notice must also get recorded by a Subcontractor within the same time period at the County Recorder’s office in the county where the project originates.

On private Commercial projects INDIANA Code § 32-8-3-3 mandates that General/Prime Contractors and Subcontractors must record a notarized INDIANA Sworn Statement And Notice Of Intention To Hold Mechanic’s Lien with the County Recorders office in the county where the project occurred within ninety (90) days after the completion of providing labor, rental equipment or materials. A recorded copy should also be delivered in person or by certified mail to the Owner of the property along with any other legal parties related to the improved property (Customer, General/Prime Contractor, Lender/Surety).

Lien claimants must file a lawsuit to foreclose against the property within one (1) year from the date the lien was recorded.
