LOUISIANA gets new notices, custom template technology (CTT)

New Orleans is an awesome city in my opinion.  Several visits there in the late 80s coincided with business tradeshows I attended.  You have to get a drink at Pat O’Briens in the French Quarter to get entertained by the dualing piano players.  Getting lunch at Commander’s Palace makes an ordinary person feel like royalty as multiple waiters serve your table like you were a King.

Thirty-four (34) notices were entirely re-written in PreLien2Lien.  They also have (CTT) Custom Template Technology, enabling each template notice to be customized for a one-time $50 fee. 

LOUISIANA is not a traditional 1st notice state for Subcontractors, but General/Prime Contractors do have to provide Owners with a Notice Of Contract. LOUISIANA Revised Statutes Annotated § 9:4811 mandates that for projects over $25,000 a Notice Of Contract be signed by the General/Prime Contractor and Owner and subsequently filed with the Recorder Of Mortgages of the parish in which the project is located before commencing work. Subcontractors still have the option of sending a Preliminary Notice. It will improve your chances of being paid on a timely basis, as it notifies all legal parties of your future right to file a Bond Claim, Statement Of Claim or Stop Notice in the event you are not paid on a timely basis.

General/Prime/Sub Contractors (Private Projects): LOUISIANA Revised Statutes Annotated § 9:4822(G) mandate that a Statement Of Claim must be recorded within thirty (30) days after the filing of a Notice Of Termination. If a Notice Of Termination has not been filed, a Statement Of Claim must be recorded within sixty (60) days of completion of providing labor or materials or the completion of the entire project. It is recorded at the Recorder Of Mortgages’ office in the parish where a project you provided construction related labor, services, equipment or materials is located.

General/Prime/Sub Contractors (Public Projects): LOUISIANA Revised Statutes Annotated § 38:2242(B) mandate that a Statement Of Claim-Public Project must be recorded within forty-five (45) days after the Public Authority records an acceptance of work of Notice Of Default. It is filed with the Public Authority for which the improvement was done for and recorded at the Recorder Of Mortgages’ office in the parish where a project you provided construction related labor, services, equipment or materials is located.
