NEW JERSEY Statutes Annotated § 2A:44A-20 mandate that on private Existing Residential projects before a Construction Lien Claim may be filed, a Notice Of Unpaid Balance And Right To File Lien must be recorded with the county clerk in the county where a project you provided labor, services, equipment or materials within sixty (60) days after the completion of providing labor or materials at a property. Recorded copies should immediately be mailed (Certified Mail highly recommended) or delivered to the Owner and other legal parties on a project.

On a private Commercial project, General/Prime Contractors and Subcontractors can record a NEW JERSEY Construction Lien Claim up to ninety (90) days after the last day providing equipment, labor, materials or services.

An licensed attorney in the state of NEW JERSEY is required for recording a lien, as it must be filed with the Civil Part of the NEW JERSEY Courts Law Division. Thereafter for perfecting the claim the party recording a lien has ninety (90) days after the last day providing equipment, labor, materials or services to record with the county clerk where the project was performed the filed lien from the Civil Part of the NEW JERSEY Courts Law Division. Finally, the claimant has ten (10) days to furnish to the Owner a recorded copy of the lien.

Claimants are required to file suit to foreclose on a NEW JERSEY Construction Lien Claim within one (1) year of the last day providing equipment, labor, materials or services for a project.

On a private Existing Residential project, General/Prime Contractors and Subcontractors can record a NEW JERSEY Construction Lien Claim up to one hundred twenty (120) days after the last day providing equipment, labor, materials or services.
